Private telcos to pay BSNL Rs 39,000 for ports, for now: SC

*Press Trust Of India*
New Delhi, July 13, 2010

First Published: 21:31 IST(13/7/2010)
Last Updated: 21:33 IST(13/7/2010)

The Supreme Court on Tuesday directed private telecom operators to pay
state-owned BSNL Rs 39,000 for every point of connection -- ports -- as
interconnection usage charges as an interim arrangement and asked the PSU
not to disconnect service. Hearing a petition filed by GSM operators'
association COAI against BSNL's demand for Rs 55,000 per port as IUC, the
apex

court said the arrangement will be continued till August 2, when the case
comes up for hearing again.

Passing an interim order, a bench headed by Chief Justice SH Kapadia
directed the Cellular Operators Association of India to pay Rs 39,000 to
BSNL as IUC to get interconnected into the PSU's network.

The Apex Court directed BSNL to file an application with details of the
amount which it want to recover from the private telecom operators, which
paid less IUC for the period between February, 2007, and May, 2010.

Meanwhile, the bench also asked BSNL not to disconnect private telecom
operators from its network till August 2, the next date of hearing which was
accepted by Solicitor General Gopal Subramanium, appearing for the PSU, who
gave a statement on record regarding it.

"Pay them Rs 39,000 and there would be no disconnection. But then you would
also have to come back with a proposal for the gap amount (claimed by
BSNL)," the bench, which also consisted Justices K S Radhakrishnan and
Swatanter Kumar, said.

The court also clarified that the cellular operators would have to pay the
differential amount to BSNL. "Somehow, you (COAI) would have to pay. You can
not say that I would not pay for which the regulation has been struck down."

The court also said that it would conduct hearings expeditiously on this
matter.

The Apex Court's direction came over a petition filed by the Cellular
Operators Association of India, which had challenged the order passed by
sectoral tribunal TDSAT on May 22, 2010.

The Telecom Disputes Settlement and Appellate Tribunal has set aside TRAI's
notification fixing the IUC at Rs 39,000 against Rs 55,000 charged by BSNL,
which was prevailing since 2001.

In its order, the tribunal had directed TRAI to start the process of fixing
the port charges afresh. Meanwhile, it also directed BSNL not to collect the
additional port charges from the operators due to them for the period
between February, 2007, and May, 2010.

Hearty Congratulations!
for the landmark victorial judgment.

This will be an eye opener for those who are in loggerheads with the
association. The timely action by the Office Bearers at SNATTA CHQ made it
possible to achieve this victory over the evil crying wolves. They not only
eaten away our quota but also became a hurdles on the way to our professional
progression. Now I think the path will be cleared for the conducting of early
JTO LICE. It is astonishing that even old monks of some union bearers were also
openly supporting the opponents against our legitimate struggle
.
To the newly joined DRTTAs: Suppose, if the VIth pay commission Recommendations
were released and approved before 1.1.2007 or just in the beginning of year
2007, the 2002 batch TTAs will not be getting such huge amount of arears (Still,
at present, around Rs. 30000/- was cut as Income Tax for the 40 months salary),
then the new pay slab will be available to the newly recruited DRTTAs, as it is
given to u now, then will u not join in BSNL as TTA after 1.1.2007?

More over, in other Govt  or Defence for the matter of sake, the fitment for
length of service is to be calculated based on 3 increment into one new
increment, but, due to the hard bargaining of recognised union (keeping in view
of their anticipated pension benefits), they got 1:1 increment fitments in the
new pay commission which is a surprise to me too. Still considering the total
emolument what a PM or SrTOA of then DOT is drawing at present or that of
Diploma Holders of other PSUs, even DR TTAs of 2002/2003 batches are not gaining
much comparatively., Still our association's effort for better pay revision for
topmost non-executive cadre (TTA) was attempted through all means, but in vain.

Remember, the future of BSNL is yours and you are going to be the decision
makers or bargainers with the BSNL Mgt irrespective of your afluenced union. So,
instead of pointing out finger against others, put your heart and sole and
improve ur professionalism. and try to set as an example to others.

You will be surprised to know that I was an Asst Engr in IAF for 4 years and 5
months since 1994 April, now after joining as DRTTA in 2002, I am still dreaming
to get my first promotion with less than 9 years of service left with to attain
retirement. Also, so many are there like me in each and every nook and corner of
BSNL who are dreaming to get their first & last promotion in life, still we are
not finding fault with the SNATTA CHQ office bearers. The prick of the new shoes
will be known only to the wearer.

A suggestgion to CHQ: Please waive off the proposed Building Fund collection
from those who are affected with negative arears. Let us be "like the fragrance
of the flowers even to the hand which crushes it" and show the youngsters a
model role for the bright future.

More V Unite, Easy V Succeed & V R Going to cross so many milestones ahead,
SNATTA's history will tell.

Healthy criticism are welcomed.

Sincerely Yours,
SN Ameen

Jeddah, KSA.

India's Supreme Court could cancel RCOM interconnect agreement

The Supreme Court of India has warned Reliance Communications (RCOM) that it
could have its interconnection agreement cancelled should it be found to
have masked international calls as 'domestic' ones through auto-call
rerouting. According to Indian Express, state-owned telco Bharat Sanchar
Nigam Ltd (BSNL) has alleged that RCOM has carried out the practice of
illegally converting international calls to domestic since 2004, which, the
former claims, has seen it suffer significant losses. In considering the
matter the Court criticised BSNL for not taking action itself against RCOM
by halting the arrangement between the two companies, but confirmed that it
will investigate the claims. Alongside the cancellation of its interconnect
agreement the Court has also said that if found guilty, RCOM could face
'stringent measures', but it did not detail what these may be. The next
hearing on the matter will now take place on 27 August 2010.

*Difference between BSNL Broadband and Airtel or Private Operator's Internet

*If you have an Airtel Internet connection* with an 'unlimited' data plan,
things may not be the same again.*Under its Fair Usage Policy*, if your
downloads cross 40 GB, your download speed will be "rationalised by up to 50
per cent for the rest of the billing cycle". What this means is that you
will get only half the speed. For example, if you have opted for the 512
Mbps unlimited plan, if you cross 40 GB, your download speeds will be
reduced to 256 Mbps till the billing cycle. The normal speed will be
restored at the beginning of the next billing cycle. Airtel says, "The

*In BSNL Broadband or Data Cards, there is no restriction imposed anywhere

Our 8 Mbps plans hardly get beyong 3 Mbps..We failed to give constant 2Mbps(for international calling) speed in my city...Atlast Customer go for Relience lease line(given fiber from BTS)  and he is satisfied also nowadays..

hi..
BSNL is not providing 8Mbps speed directly.
BSNL providing upto 8 Mbps speed only it means speed will vary from 2 to 8
mbps. try to understand the plan details. and then let the customer satisfy.
Talk to NIB staff to get the profile of the BB connection change to 8 mbps
profile.

check the speed at MDF and then check at customer premises. BSNL is giving
good speed but the service is not good that i admit we took long time to
understand the solution actually. also check NSR and Attenuation levels at
customer premises.

if u have any problem of any kind regarding then u can talk to me at
bandhanpreetsingh@bsnl.co.in

otherwise we have wise people in the group those who can help u out.,

Subject: Congratulations

Sincerely Yours,
SN Ameen

Well said Ameen sir
But the vitamin "m" has to play the major role for all type of on going process.
About the fitment I don't think this is the final . Different places different type of fitment is existing. I request the CHQ Office bearers to clarify the on going process and follow up action regarding pay protection of 2007&2008 batches to the groups .

I fail to understand why 2009 batch is being ignored while discussing for pay revision and fitment benefit application. Do these people think that this batch will never understand this trick ? or they think they are not worth to care for
