*Oh No.... Now, BSNL's new Rs 2000 crore tender runs into trouble.*

State-owned telecoms company BSNL's latest tender for 5.5 mn GSM lines worth
around Rs 2,000 crore has run into controversy,* **risking the possibility
of delaying the company�s expansion yet again. *

* Controversies related to its tendering process has resulted in BSNL being
unable to place any orders for telecoms equipment over the past four years,
allowing private companies to steal a march over the PSU, and also resulting
in the telco posting a loss of Rs 1,822.65 crore for the year to end March,
a first in the company�s history *

The new controversy relates to Nokia Siemens Networks wanting BSNL not to
enforce a clause in its latest tender that mandates vendors to share their
source codes with the Indian government. This has been opposed by Ericsson,
which dropped out from placing a bid as the world�s largest telecoms
equipment maker said it would not follow the new tender clause that made it
mandatory for equipment suppliers to submit source codes to the government.

Ericsson executives also maintain that if BSNL were to make any concessions
to Nokia Siemens and relax this clause, it would violate existing government
guidelines which does not allow the telco to change rules midway through the
tendering process. Ericsson�s objections are further strengthened by the
fact that the company has in the past emerged as the lowest bidders in
BSNL�s tenders.

Meanwhile, Ericsson has also approached the Central Vigilance Commission
seeking a probe into BSNL�s move to cancel the earlier tender, which banned
the participation from Chinese vendors such as Huawei and ZTE.

*The 5.5-mn line tender is also the first the PSU has floated after it
cancelled its 93- mn lines contract, the world�s largest for telecom
equipment, earlier this year. The contract was abandoned after it ran into
several controversies � including court cases and a probe by the Central
Vigilance Commission, which unearthed several irregularities in the
tendering process. BSNL had earlier (in July) shortlisted three telecom
equipment vendors�Ericsson, Nokia Siemens and Alcatel Lucent�for its 5.5 mn
lines contract. A government directive had prevented the telco from placing
any orders with telecom gear makers from China, especially if the networks
had to be installed in circles that share international boundaries. *

Even as this tendering process was on, the telecoms department unveiled new
rules that made it necessary for foreign equipment companies to put their
software in the equivalent of a sealed envelop to be opened by Indian
authorities only in a security threat. *Chinese vendors Huawei and ZTE were
the only companies that offered to comply with India�s new norms, paving the
way for them to supply equipment. *

In September, BSNL cancelled its earlier tender and invited fresh bids from
Alcatel-Lucent, Ericsson, Huawei Telecommunications , Siemens Networks and
ZTE Telecom.

Even as Western firms opposed the new security norms, the Prime Minister�s
Office intervened and asked the telecom ministry to allow mobile phone
companies and vendors to follow either the recently introduced norms or the
security guidelines issued last year. The rules issued last year do not
mandate vendors to share their source codes in an escrow account in India.
Instead, it allows mobile phone companies here to import networks and other
related equipment after giving a self-certification of security compliance.

NSN has argued for a relaxation of the escrow clause on the grounds that
India now allows companies here to import networks and other related
equipment after giving a self-certification of security compliance. Ericsson
on the other hand has told the CVC that BSNL chose to enforce the escrow
clause despite the telecoms ministry allowing mobile phone companies and
vendors to follow either the recently introduced norms or the security
guidelines issued last year. �It is relevant to note that by allowing both
the guidelines, BSNL could have ensured maximum competition (five bidders).
But, now, they would possibly end up with only those two companies being
qualified,� Ericsson said in its letter to the CVC.

Mobile phone users who have been complaining ad nauseam about unwanted
marketing calls have been extended fresh hope of relief, as Telecom
Authority of India chairman H S Sharma on Sunday held out a *deadline of 15
November for regulation to end such unsolicited calls.*

"We have finished the entire process of consultations. We are in the process
of finalising the regulation for unsolicited calls and messaging. We wanted
to do it by the end of October but there is slight delay. We may be out with
regulation before 15 November," Sharma told media persons on the sidelines
of a book release function in New Delhi.

He said the contents of the proposed regulation could not be disclosed at
this moment, but it would "solve" the problem. He added that the telecom
regulator has been testing the technicalities of the proposed regulation in
some telecom circles.

*The Department of Telecommunications had to face embarrassment when finance
minister Pranab Mukherjee got an unsolicited call from a telemarketing
company earlier this month.*

TRAI's earlier attempts to curb the menace did not yield desired results.
The* 'do-not-call registry' introduced three years ago by the telecom
regulator proved ineffective for various reasons.*

The Letter attached h/w is of GOI and this letter was not endorsed by BSNL shhowing finential problem so J&K LTC is not reimbursed against home town LTC and air fare is also not reimbursable. if any have documentory proof of BSNL CO then pl mail.
