Dear SN Ameen,
Sorry I could not reply to your mail earlier,but I think as an internal candidate you are not eligible for the age relaxation in LICE.Had it been a outsider vaccancy then you would have definitely got the age relaxation as per your category but in this case as far as I know you are not get any benefit.
Anyway You can always approach CAT,because previous decisions can be and have been reviewed in some instances.Please find attached some court cases and judgements on age relaxation and see if it can help you in any way.

Greetings!
I am an Ex-Serviceman with 21 years of service in IAF. I joined BSNL as TTA through Competitive Exam in the batch of 2002. At present I am serving in KSA on Deputation through TCIL. My SSA is Nagercoil, Tamil Nadu.
At the onset, I extend my sincere gratitude for all of our union office bearers' struggle to get the LICE notification with the relaxation of 7 years of regular service. But recently, when I have gone through the eligibility conditions for JTO RR 2001, the maximum age limit permissible is given as below 50 years, whereas, my present age is above 50 years (DOB 20/05/1959).
Now, I would like to know whether I will be automatically eligible for age relaxation as an Ex.SM to write the JTO Promotional exam through LICE or not?
Moreover, in the Annexure to BSNL Corporate Office letter no. 404-37/2009- Pers.(Legal) dated 11.11.2009 (Attachment to mail sent by Mr. GS Rajawat on Latest Developments in MT Cases dated 11.11.2009 in SNATTA Yahoo group), an Ex-Serviceman Mr.Shankar Lal Kumhar AO has filed a petition in CAT Ahmedabad vide OA No. 367/09 requesting to allow age relaxation to internal candidates in the category of Ex.SM for MT (Accts) Examination.
So my doubt is whether I should also file a petition in CAT to get the age relaxation to sit in JTO LICE exam or can I give a representation to Corporate Office through proper channel for availing age relaxation. Some more Ex.SM.TTAs might be also affected, I suppose.
Your earliest and sincere advice will be solicited.

Dear Friend
At a first glance you are not eligible for JTO LICE but as you mentioned some letter/writ filed by some ESM in that case if stay is given and the man concerned is permitted to appear in JAO exam then up to some level you are eligible. In best case you along with persons who are affected if approach to court it may be more useful.You may go through union but I think it is too late and the union will not get time fore ESM which has negligible vote above all it has lot of issue to handle, your issue may be at the last priority.

I can say this because I had a previelage to be a part of the wage comm meetings.I had given a good long commentary on the meeting I had attended but you seem to forget all.
On 3rd March itself Mr R K BATRA had propsed that the recognised union can sign on the agreement right away,at par with executives,But GS BSNEU insisted that the periodicity should be 5 instead of 10 years,upon which the managment had said that they were ready to write next wage revision simultaneously with executives,in the successive meetings but Nmaboodiri was adamant on his demands.
And what we got?
No periodicity will be mentioned. Next wage revision for non-executives will be along with executives.
we should be brave enough to admit our failures and follies.
We should not hide our head in sand like Ostrich on seeing the enemy.
And where to discuss all the issues other than Yahoogroups? whether it relates to BSNLEU or any other topic.
Yes I can call you or for that matter anyone one because everyone has a phone line,but that would remain between us only So instead of one to one communication we should encourage many to many communication.
And its dirty politics and trade union politics is no different so No FATHER NO SON relation ship exist not for me atleast ,just OPPURTUNISM.Select the winning horse,this time it was BSNLEU,it may be NFTE or FNTO or BSNLEU again.We were kingmakers once,remember, we can be again next time also,let THEM(BSNLEU) not forget this,so always assert what we all can do.

In the meeting of wage negotiation held today, 17th November 2009 , the following understanding has been reached:
1. 30% fitment on pay + 68.8% IDA
2. ivNo periodicity will be mentioned. Next wage revision for non-executives will be along with executes.
3. Increase of fitment on 68.8% to 78.2% IDA both for non-executives and executives simultaneously.
4. 3% annual increment
A great start has been made. The next meeting of the committee will be held on 19th November to discuss pay scales and other issues.

I can say this because I had a previelage to be a part of the wage comm meetings.I had given a good long commentary on the meeting I had attended but you seem to forget all.
On 3rd March itself Mr R K BATRA had propsed that the recognised union can sign on the agreement right away,at par with executives,But GS BSNEU insisted that the periodicity should be 5 instead of 10 years,upon which the managment had said that they were ready to write next wage revision simultaneously with executives,in the successive meetings but Nmaboodiri was adamant on his demands.
And what we got?
No periodicity will be
mentioned.
Next wage revision for non-executives will be along with executives.
we should be brave enough to admit our failures and follies.
We should not hide our head in sand like Ostrich on seeing the enemy.
And where to discuss all the issues other than Yahoogroups? whether it relates to BSNLEU or any other topic.
Yes I can call you or for that matter anyone one because everyone has a phone line,but that would remain between us only So instead of one to one communication we should encourage many to many communication.

In the meeting of wage negotiation held today, 17th November 2009 , the following understanding has been reached:
1. 30% fitment on pay + 68.8% IDA

3. Increase of fitment on 68.8% to 78.2% IDA both for non-executives and executives simultaneously.
4. 3% annual increment
A great start has been made. The next meeting of the committee will be held on 19th November to discuss pay scales and other issues.

I totally agree with u. I had gone through every post of our members on major achievement regarding wage revision. These guys have diverted your topic of discussion. You had never commented on SNATTA CHQ leaders but you have criticized BSNLEU CHQ team for dragging wage revision issue. So, my request to all members of our group, please read the mail carefully, look in the matter and then comment. Do not divert the flow of discussion or start another topic in between. We have faith in SNATTA CHQ, CIRCLE and DISTRICT leaders and appreciate the great efforts made by them for the welfare of DRTTAS. We are proud of our members who were in the wage negotiation committee. There is no doubt about the work performed by our SNATTA leaders. But as u said Mr. Namboodiri and Co. has dragged this issue at the will of their political matters only. We were the king makers in last verification and will be in the next verification also. They have to depend upon us in
technical matters and in union politics also. We are engineers and let them know we are not high school pass foolish line men. We have supported them with some conditions. So, maintain pressure on them to fulfill that commitments made by them. Be united and fight for achieving our goals.

I would like to reply you just once on this topic and then out of this.

2.Moderators may edit or reject the posts,if the language is abusive or derogatory ,otherwise
3.publish all the mails even if its useful or useless
4.do not jump to any conclusion early or pass any judgement or force the same on others.
Because,Yahoogroups is nothing but an extension of the discussions that usually take place in offices,home ,friend circle.Through this group we broaden that circle by including all the members and this would only strengthen the unity,bond and trust between the individuals in association.
And I am not here to time pass and even if I am,then also I believe that I would learn something useful from this platform.

4. 3% annual increment
A great start has been made. The next meeting of the committee will be held on 19th November to discuss pay scales and other issues.

What has happened to the group? Everyone seems to be too impatient, ready to
hurt other´s feelings at the drop of a hat. Please remember once said,
words can never be taken back.
There is one simple solution to avoid these controversies. Since the
time this group is formed I have always discouraged name calling. Every
mail should be addressed
to the group as a whole e.g. Dear, Dear friends etc. (This should be
followed not as a rule but in true
spirit). Only in those cases where you are replying
to somebody's individual query that is general in nature and may be
helpful for
others also, then only the mail can be addressed to individuals by
name. And if
you are having some difference of opinions and wanted to clear the
misunderstandings, then you can do so to their individual mail ids also.(
but I would advice you, better keep silent than to hurt someone's feelings, who
may be sitting 1000 Kms away and you may not be able to meet him in your whole
life).
Anyway you all are sensible persons to keep away from such petty differences. And
at this point of time when we are so close to the first LDCE to be declared in
few months´ time these types of incidents seems quite out of place. Everyone
should concentrate on the LDCE (personally & collectively).
About the root cause of the problem
In the news item on BSNLEU's website that -MAJOR achievements in wage
negotiation-, some objected to the word MAJOR.
If someone failed in exam six
time and on 7th attempt he passed with just pass marks, you can say
that he
could have topped the university, but for him mere pass marks are
achievement
(MAJOR). The news item that appeared on there website is an eyewash for
their
members, obvoiusly not meant for educated people like TTAs. Not all of
BSNLEU members are aware of the facts like TTAs do. BSNLEU
gave them a reason to smile.
(The only thing lacking here is that SNATTA
website should not have copy pasted/linked to the same item, instead what
SNATTAians wanted to know, is the details of the meeting from their representative's
view point, just like Vikas was giving earlier. It gives a sense that their
representative is active in the meeting. Also engineers never cared about the result;
they are only interested about the processes. If the process/effort is there
then result doesn´t matter). I would be grateful if the GS, please take note of this.
Further how does it matter to us ? All along we knew this thing is coming our
way. so it came. However late it comes doesn't matter much coz arrears will be
paid and mostly what we loose is perks and allowances. But since HRA was issued
from FEBRUARY and CCA, Diet allowance stopped from AUG there is nothing much to
regret also.
About blaming BSNLEU/Namboodri for dragging the issue too long: As far as I
know he was not dragging the issue just for fun. Early settlement has its own
negatives. Bright example is before you all. BSNL is the first PSU that implemented 2nd PRC
recommendations 4 executives by granting 68.8% DA neutralization. After that
all other PSUs followed with 78.2% (orders issued after implementation in
BSNL). Although DA neutralization is common for all and is a right of every
employee, BSNL is not in a position to implement it mainly due to increasing

There is one simple solution to avoid these controversies. Since the time this group is formed I have always discouraged name calling. Every mail should be addressed to the group as a whole e.g. Dear, Dear friends etc. (This should be followed not as a rule but in true spirit). Only in those cases where you are replying to somebody's individual query that is general in nature and may be helpful for others also, then only the mail can be addressed to individuals by name. Anyway you all are sensible persons to keep away from such petty differences. And at this point of time when we are so close to the first LDCE to be declared in few months´ time these types of incidents seems quite out of place. Everyone should concentrate on the LDCE (personally & collectively) .
About the root cause of the problem
In the news item on BSNLEU's website that -MAJOR achievements in wage negotiation- , some objected to the word MAJOR.
If someone failed in exam six time and on 7th attempt he passed with just pass marks, you can say that he could have topped the university, but for him mere pass marks are achievement (MAJOR). The news item that appeared on there website is an eyewash for their members, obvoiusly not meant for educated people like TTAs. Not all of BSNLEU members are aware of the facts like TTAs do. BSNLEU gave them a reason to smile.
(The only thing lacking here is that SNATTA website should not have copy pasted/linked to the same item, instead what SNATTAians wanted to know, is the details of the meeting from their representative' s view point, just like Vikas was giving earlier. It gives a sense that their representative is active in the meeting. Also engineers never cared about the result; they are only interested about the processes. If the process/effort is there then result doesn´t matter). I would be grateful if the GS, plaese take not of this.
Further how does it matter to us ? All along we knew this thing is coming our way. so it came. However late it comes doesn't matter much coz arrears will be paid and mostly what we loose is perks and allowances. But since HRA was issued from FEBRUARY and CCA, Diet allowance stopped from AUG there is nothing much to regret also.
About blaming BSNLEU/Namboodri for dragging the issue too long: As far as I know he was not dragging the issue just for fun. Early settlement has its own negatives. Bright example is before you all. BSNL is the first PSU that implemented 2nd PRC recommendations 4 executives by granting 68.8% DA neutralization. After that all other PSUs followed with 78.2% (orders issued after implementation in BSNL). Although DA neutralization is common for all and is a right of every employee, BSNL is not in a position to implement it mainly due to increasing workload and also financial constraints. NEW DELHI: India will introduce mobile number portability on December 31, a move that could further intensify the stiff competition in the world's fastest-growing wireless market and push call charges lower.
Mobile Number Portability (MNP), which allows users to retain their number even if they switch operators, will be introduced in two phases, the telecoms regulator said, first in the metro cities and the so-called Category A telecom zones and in other areas by March 20.
MNP helps in "increasing competition between the service providers and acts as a catalyst for the service providers to improve their quality of service," the Telecom Regulatory Authority of India (TRAI) said on its website.
The regulator also notified certain charges associated with MNP and said switching charges for users must not exceed Rs 19. However, operators are free to levy any amount less than or equal to this charge.
Four new firms including ventures of international telecom operators Telenor, Etisalat and Batelco are set to start services in India this year and MNP would make it easy for them to lure existing subscribers.
The Department of Telecommunications
(DoT) had issued guidelines for its implementation in the country in August last year
